The Loophole in the Law: How Calhoun County’s New Recovery Home Rules Leave Out the Most Important Part

 September 12, 2026

The headlines sound definitive: the Calhoun County Commission has cracked down on local halfway houses and sober-living homes. Relying on the authority granted by Alabama Act 2025-109, county commissioners have unanimously passed resolutions aimed at creating strict oversight, mandating self-registration, enforcing strict bed limits, and assessing steep fines for non-compliance.

On paper, it looks like a sweeping victory for local accountability. But if you dig into the actual text of the local rules, there is a massive catch.

The commission’s resolution contains a glaring loophole: it only applies to facilities housing court-ordered or county-supervised individuals. If a recovery home simply chooses not to accept court-ordered residents, the county's rules do not pertain to them at all.

When Oversight Can’t Keep Up With the Crisis

Alabama is facing a relentless substance‑use epidemic, one that has strained emergency rooms, fractured families, and flooded court dockets across the state. In response, judges and probation systems have increasingly turned to recovery residences and sober living homes as alternatives to incarceration. But the very system meant to oversee and support these homes is showing signs of severe strain.

At the center of the issue is the Alabama Alliance of Recovery Residences (AARR) — the state affiliate responsible for certifying and monitoring recovery residences under nationally recognized standards.
